CONSENT AND NOTICE REGARDING ELECTRONIC SIGNATURES

The Electronic Transaction Act 2002 (Act) governs the legal application of electronic signatures in New Zealand. Bellingham Wallace Limited's secure electronic signature service is provided by Adobe Systems Incorporated ("Adobe"). Adobe's  Document Cloud eSign services complies with industry security standards, including HIPAA and PCI v3.0 used by the payment card industry.

1.  Electronic Signature Consent 

Please read the following information, by selecting the "I Accept" button associated with this link you are agreeing that you have reviewed the following consumer disclosure information and consent to transact business using electronic communications, to receive documents that require your signature electronically, and to utilise electronic signatures in lieu of using paper documents.

 

2. Electronic Signature Agreement

By selecting the "I Accept" button associated with this link, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting "I Accept" you consent to be legally bound by this Agreement's terms and conditions. You further agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action constitutes your signature (hereafter referred to as "E-Signature"), acceptance and agreement as if actually signed by you in writing.

You also represent that you are authorised to enter into this Agreement for all persons who own or are authorized to access any of your accounts and that such persons will be bound by the terms of this Agreement. You further agree that each use of your E-Signature  constitutes your agreement to Adobe's general terms of use as they exist on the date of your E-Signature.

If you prefer not to receive and sign documents electronically, then you may request to receive paper as described below.

 

3. Request for Paper Copies

You may request paper copies of the documents for signing if you prefer to do so. Please note that you do have the ability to download and print any open or signed documents sent to you via Adobe's Document Cloud eSign services. This can be done by using the PDF and Print icons.

If you still wish to receive a paper copy of the document for signing, then please select the 'I will not e-sign' option associated with this link. By doing so you acknowledge that Bellingham Wallace reserves the right to charge you a reasonable fee for the production and mailing/couriering of paper versions of documents. Currently Bellingham Wallace Ltd does not charge, however.

 

4. Valid and current email address

Your current valid email address is required by Bellingham Wallace Limited in order for documents to be electroncally sent to you in order to obtain your E-Signature. By selecting the "I Accept" button associated with this link, you agree to keep Bellingham Wallace Limited informed of any changes in your email address. You may modify your email address by submitting a request to info@bellinghamwallace.co.nz.  

 

5. Hardware, software and operating system

You are responsible for installation, maintenance, and operation of your computer, browser and software. By selecting the "I Accept" button associated with this link, you agree that Bellingham Wallace Limited is not responsible for errors or failures from any malfunction of your computer, browser or software.
